Terms of Service

✦ Please be sure to read ALL of my Terms of Service before commissioning me

✧ General

• Prices are subject to change based on demand.
• I have the right to reject any order for any reason.
• I do NOT permit any of my works to be used in regards to advertising or profiting from NFTs, blockchain-related technology, cryptocurrency or any other adjacent future technologies.
• I do NOT permit any of my works to be used in training AI models.

✧ Payment

• Commissions can be paid either 100% upfront or split 50% upfront and 50% after the work has been finished.
• If a commission is paid 50%, WIPs and final deliverables will be watermarked and low resolution until the final payment is paid.
• Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.
• Initial payment for commissions must be paid within 72 hours or else the the commission will be cancelled.
• Once work has begun or payments have been made, the client acknowledges work and deliverables are digital and there are no physically shipped goods to receive.

✧ Deadlines and Delivery

• Please tell me the deadline in your form if you have one.
• The waiting time can sometimes take a week or up to a few months depending on the commission work load and my day job situation.

✧ Revisions

• You get 3 rounds of changes on the commissioned piece included in the price.
• A fee will be added if you want something changed on the final drawing; unless a misunderstanding from my side has been made.
• If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
• If your reference is unclear to start, changes will come at an extra charge.

✧ Copyright & Usage

✦ I, P3achsalt:
• I reserve the right to cancel and refund the order at any time for any reason.
• I retain all copyrights over the commissioned artwork.
• Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth) or as agreed upon.
• I will NOT claim the intellectual property (IP) of the commissioned artwork.
• I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms or with explicit permission to do so from the customer.
• I reserve the right to post the commissioned artwork online, in my portfolio.✦ You the Client:
• You may upload the commissioned artwork with credit (ex. @p3achsalt) on any website and social channels with no direct monetization.
• You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.)* without my (the artist's) consent.
• You may NOT alter the commissioned artwork without my (the artist's) consent.
• You retain the rights to the intellectual property (IP).
• You may NOT use the commissioned artwork for commercial purposes.*✦ The following is considered copyright infringement:
• Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
• Claiming the artwork as your own.
• Altering the artwork without my consent.*Commercial rights to the image may be purchased before a commission request is processed for an additional fee

✧ Refunds

• The buyer is not allowed a refund once I started working on the commission.
• If for any reason I am unable to finish your commission for any reason, you will receive a refund based on how much work is left to be done on the commission.
• If you cancel your order before I started it, you can get a full refund.
• If you are getting a refund, do not request a chargeback.
• I will transfer the money back to you myself.
• If you request a chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. Furthermore, you will be blacklisted from commissioning me again.

✧ Confidentiality

• Unless an NDA is signed, any work commissioned will be suspect to being worked on stream. There will be an additional fee for NDA work.• The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

✧ Acceptance

• Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.

By paying for a commission, you hereby agree that you’ve read the terms of service.

These are general rules for most commission types. If there are other things of note they will be listed on the price page.

*Some things may not be included but I hold the right to reject a commission if I'm not comfortable accepting it

• Additional Panels: 20% added to Base Price per additional panel
• Additional Chibi Characters: +10% Base Price per additional Character per panel
• Non-Chibi Character Upgrade: +20% per Character (Not included in Base Price)

Price Calculation Breakdown

Ex: "I would like to add 2 more panels w/ 2 additional chibi character for 4 of the panels"

✦ Important
• $150 is the starting price, I will not be giving discounts for anything less than what is listed in the "Includes" points
• Prices will fluctuate depending on the script submitted
• Prices for add-ons are rough estimation can change due to complexity and project requirements
• If you have a rough draft with stick figures and dialogue, I will take 10% off the price total
• I, P3achsalt, will be working closely with the client throughout the process of this making this commission as it require a lot of feedback and checking
